Home Defense Shooting Ruled Justified
Collegeville, Pennsylvania – WFMZ reports the Montgomery County District Attorney’s Office has declined to press charges against a homeowner who shot and killed an armed intruder the night of February 16th.
Officers were dispatched to a report of shots fired around 11:30 p.m. at a home located on East Third Ave. When law enforcement entered the home, they noticed signs of the forced entry on the front door, then they found 55-year-old Robert Pollock lying dead at the bottom of the stairs.
After searching Pollock, officers found a Smith &Wesson .357 revolver.
Speaking with the occupants, they were told the victims had been awakened by the forced entry and confronted Hayes from the top of the stairs.
When the suspect pointed his weapon up the stairs and began to advance towards the victim and his female companion, the homeowner fired, striking Pollock several times.
He was pronounced dead at the scene.
A careful investigation was completed including a toxicology report which showed that Pollock had been under the influence of both drugs and alcohol when he broke his way into the resident’s home.
According to District Attorney Kevin Steele, the shooting met all of the requirements needed for it to be ruled justified according to the state’s Castle Doctrine.
“In plain language, this is a justified shooting under the Castle Doctrine since all necessary elements were met,” Steele said in the statement obtained by WFMZ. “Someone broke into the residence, which is a felony; the intruder was brandishing a firearm that was pointed at the occupant leading him to believe that his and other lives were in danger; and the shooter did not provoke the encounter that led up to the slaying.”
